Terms of Service

Thank you for using nail-inspo! These Terms of Service (“Terms”) govern your access to and use of the website, app, and all related services, features, and content operated by nail-inspo (“nail-inspo,” “the Service,” “we,” or “us”). Please read these Terms carefully. By accessing or using nail-inspo, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

1. The Service

nail-inspo is a structured nail inspiration platform. We help you discover, filter, compare, and save nail designs based on attributes like shape, color, finish, style, occasion, and more. Some content is contributed by professional nail artists (“Pro Users”), and some is curated by our editorial team. The Service may include links to third-party products or services, which are clearly identified.

2. Using nail-inspo

a. Who can use nail-inspo

You may use the Service only if you follow these Terms and all applicable laws. Any use or access by anyone under the age of 16 is not permitted. If you are between 16 and 18, you may only use the Service with the consent of your parent or legal guardian. When you create an account, you must provide accurate and complete information.

If we have previously disabled your account for violating these Terms, you may not create a new account without our express written permission.

You agree not to scrape, collect, or access data or content from nail-inspo by automated means (without our express prior permission), or access data you do not have permission to access.

b. Our license to you

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for personal, non-commercial purposes (unless you have a Pro account, in which case Section 2(c) applies). You may not: (i) modify or make derivative works based on the Service; (ii) reverse engineer the Service; or (iii) copy any features or functions of the Service.

c. Pro accounts

If you are a nail artist or salon professional and want to use nail-inspo to showcase your work, you must create a Pro account. By creating a Pro account, you agree to any additional terms that apply to Pro Users. If you open a Pro account on behalf of a business, you represent that you are authorized to bind that entity to these Terms.

3. Your Content

a. Posting content

nail-inspo allows you to upload, save, and share content such as photos, descriptions, and metadata (“User Content”). You retain all rights in your User Content and are solely responsible for it. You will only post content that you have the right to share and that does not infringe the intellectual property rights of others or violate applicable law.

We may remove, restrict, or limit access to User Content that violates these Terms or where required by law. We may also suspend or terminate accounts that repeatedly or seriously infringe third-party rights, violate the law, or violate these Terms.

b. How we and other users can use your content

By uploading or publishing User Content on nail-inspo, you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, display, reproduce, modify, and distribute your User Content for the purpose of operating and improving the Service. This includes displaying your content to other users, featuring it in curated collections, and using it in promotional materials for nail-inspo.

Content you save privately (e.g., to personal boards) will not be shared publicly unless you choose to publish it.

c. How long we keep your content

After you delete your account or remove User Content, we may retain copies for a reasonable period for backup, archival, or legal purposes. Content that was shared with or saved by other users may continue to be available to them after your deletion.

d. Rights confirmation

When uploading content — particularly as a Pro User — you may be asked to confirm that you own or have permission to publish the images. We take rights seriously and may review, restrict, or remove content where rights cannot be verified.

e. Feedback

If you provide suggestions, ideas, or feedback about the Service, you agree that we may use them without any obligation to compensate you or keep them confidential.

4. Intellectual Property

You acknowledge that we own all rights, title, and interest in nail-inspo and all related intellectual property (including copyrights, trademarks, and patents). You may not use our branding, logos, or other intellectual property without our prior written consent. This does not affect your ownership of your User Content.

We respect the intellectual property of others. If you believe content on nail-inspo infringes your rights, please contact us so we can investigate and take appropriate action.

5. Security

We care about the security of your account and content. While we take reasonable measures to protect the Service, we cannot guarantee that unauthorized third parties will not be able to circumvent our security measures. You are responsible for keeping your password secure and for notifying us immediately of any unauthorized access to your account.

6. Third-Party Links and Services

nail-inspo may contain links to third-party websites, products, or services (for example, links to purchase nail products). We do not endorse or assume any responsibility for third-party content, products, or services. You access them at your own risk.

7. Termination

We may suspend or terminate your access to the Service if you violate these Terms. Where appropriate, we will notify you and provide an opportunity to appeal. You may also delete your account at any time through your profile settings.

Upon termination, Sections 3, 4, 8, 9, 10, 11, and 12 of these Terms will continue to apply.

8. Disclaimers

To the extent permitted by applicable law, the Service is provided “as is” without warranty of any kind, whether express or implied. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. nail-inspo is not responsible for User Content posted by users or any third-party content linked from the Service.

Nail designs shown on the platform are for inspiration purposes. We make no representations about the accuracy of difficulty ratings, salon times, or product recommendations. Always consult a professional nail artist for personalized advice.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, resulting from (a) your use of or inability to use the Service; (b) any conduct or content of third parties on the Service; or (c) unauthorized access to your content or account.

Our aggregate liability for all claims relating to the Service shall not exceed one hundred euros (€100). This does not affect any liability that cannot be excluded or limited under applicable law.

If you are a consumer in the EEA or UK, this limitation does not apply to damages arising from our negligence or willful misconduct, or any liability that cannot be limited by law.

10. Governing Law and Jurisdiction

If you are a consumer in the EEA, Switzerland, or the UK, these Terms are governed by the law of the country where you live, and disputes may be resolved in the courts of your country of residence.

In all other cases, these Terms are governed by the laws of Germany, and disputes shall be resolved in the courts of Berlin, Germany.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you (for example, by email or through the Service) before the changes take effect. Your continued use of nail-inspo after the update constitutes your acceptance of the revised Terms.

12. General

These Terms constitute the entire agreement between you and us regarding the Service. If any provision is found to be invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of that provision.

These Terms, and any rights and licenses granted, may not be transferred or assigned by you but may be assigned by us. Any attempted transfer or assignment by you shall be void. If we assign these Terms, we will provide you with reasonable notice and you may terminate your account if you do not agree.
